ABSTRACT
Every society goes through its own problems and processes of change in content. As
a social problem, crime is a phenomenon that is the same in all societies by definition, but
differs in terms of criminal sanctions. While it is a crime for one period, it is not included in
the crime category in another period, while an action subject to a crime in one place does
not take place in another country. The far-reaching nature of crime makes it difficult to
explain and understand. In general, it is the investigation of juvenile delinquency, which is
a more important subfield than the investigation of crime. The coding of the child and
childhood as “innocent, pure, clean” in all societies makes it difficult to associate and
investigate the courthouses and/or courts, where the legal institution is practiced, and
prisons, which are the means of punishment.
Juvenile delinquency is a field on the basis of which lifelong delinquency is built
and contained. Juvenile delinquency is a complex area that needs to be approached more
sensitively and in detail than other cases, as the child is both the perpetrator and the victim
of the crime.
When a child is looked at, all the dynamics of the society are seen. In this context,
understanding and explaining juvenile delinquency; It provides an understanding of the
structure of society, the dynamics of the state, the family and educational institutions that
build a social space, and lifelong criminality. This nature of juvenile delinquency enabled it
to be chosen as the subject of the thesis.
The thesis was made with the lawyers, the first person children talk to in detail when
they commit a criminal act. This study is important in the context of being the first scientific
study in the literature that makes use of lawyer experiences in the context of juvenile
delinquency.
Within the framework of the thesis, 25 lawyers specializing in juvenile and criminal
law were interviewed. Lawyers were asked questions about the family that led their children
to delinquency, their place of residence, socio-economic status, age status, school, peerrelative circle, awareness of crime and the reasons for repeating the crime.
In the first part of the study, the methodology of the research is mentioned. In the
second part, there is a conceptual framework for making sense of the study. In the third part,
a theoretical framework has been constructed to be used in the explanation of the study. In
the fourth chapter, a literature review is given to prove how important the study is. In the
fifth section, the analysis and discussion of the research findings are included, while the sixth
section includes the conclusion part. There are comments on what can be done to prevent
juvenile delinquency.
