ABSTRACT
As ch ldren have not yet completed the r development, they should be subject to a d fferent ated
and separate just ce system. The research a ms to nvest gate whether leg slat on and pract ce
regard ng juven le cr m nal proceed ngs are ncons stent w th ch ldren's r ghts; to expla n how
the subjects perce ve the tr al process and how t affects the r l ves; and to dent fy the
exper ences and recommendat ons of adults, experts, and lawyers who have been tr ed as
ch ldren. A rev ew of the l terature shows that there s a pauc ty of research on ch ldren's
exper ences of cr m nal proceed ngs, w th most stud es focus ng on the reasons for nvolvement
and percept ons of cr me. In th s study, qual tat ve nterv ews were conducted w th people over
the age of 18 who had been nvest gated and prosecuted as ch ldren nvolved n cr me, as well
as w th lawyers and experts nvolved n juven le cr m nal proceed ngs. The results were
analyzed us ng a content analys s method and pract ce contrary to the best nterests of the ch ld,
the ch ld's r ght to l fe and development, and the ch ld's r ght to part c pat on n the nvest gat on
and prosecut on of ch ldren nvolved n the cr me were dent f ed. As a result of these pract ces,
t was observed that the part c pants' nvolvement n the just ce system led them to be exposed
to d fferent cr m nal env ronments and negat vely affected the r fam ly and peer relat ons,
educat on, bus ness l fe, and relat ons w th the state and the law. They were also found to feel
st gmat zed, hopeless, gu lty, ashamed, confused, and sad as a result of the r nvolvement n the
just ce system, to have developed a bel ef that they had m ssed out on the r ch ldhood, and to
have anx ous uncerta nty about the future. At the end of the study, recommendat ons for juven le
cr m nal proceed ngs are presented to serve a ch ld-fr endly juven le just ce system.
